Privacy policy
Your privacy matters to us. This Privacy Policy explains what personal information we collect when you use our website bbqboi.nz (the "Website") or buy from us, how we use and protect it, and the choices and rights you have. We handle your personal information in accordance with the New Zealand Privacy Act 2020 and its Information Privacy Principles (IPPs).
This policy forms part of, and should be read with, our Terms of Service and Returns & Refunds Policy.
1. Who we are
The agency responsible for your personal information is:
Barbecue B.O.I. Address: 5 Fairway Drive, Kerikeri 0230, New Zealand Email: info@bbqboi.nz Phone: 021 027 91442
2. What personal information we collect
Depending on how you interact with us, we may collect:
- Identity and contact details — your name, email address, phone number, and billing and delivery addresses.
- Order information — the products you buy, order history, and any notes or special instructions.
- Payment information — payment is processed securely by our payment providers (such as Shopify Payments and PayPal). We don't store your full card number; we may receive limited details such as the card type, the last digits, and whether a payment succeeded.
- Account information — if you create an account, your login details and saved preferences.
- Communications — messages you send us by email, phone, our contact form, or social media.
- Marketing preferences — whether you've opted in to receive our emails or messages.
- Website and device data — collected automatically as you browse, such as your IP address, browser and device type, pages viewed, and how you found us (see Cookies, Section 7).
You don't have to give us personal information, but if you don't, we may not be able to process your order, deliver your goods, or provide certain services.
3. How we collect your information
We collect personal information:
- Directly from you — when you place an order, create an account, subscribe to our emails, enter a competition or promotion, contact us, or interact with our Website or social media.
- Automatically — through cookies and similar technologies when you use the Website.
- From third parties — such as our e-commerce platform (Shopify), payment providers, couriers, and analytics or marketing tools that help us run the Website.
Information about other people (indirect collection)
Sometimes you may give us personal information about someone else — for example, the name and delivery address of a gift recipient. Where we collect personal information about a person from someone other than that person, we'll take reasonable steps, consistent with IPP 3A of the Privacy Act 2020, to make sure they're aware we hold their information and why, unless an exception applies. Please only share another person's details if you're entitled to do so.
4. Why we use your information
We use your personal information to:
- process, fulfil and deliver your orders, and take payment;
- manage your account and provide customer service and support;
- handle returns, refunds, warranty and Consumer Guarantees Act matters;
- send you order, shipping and service updates;
- send you marketing and BBQ content where you've opted in (you can opt out at any time);
- improve and secure our Website, products and service, including analytics;
- detect and prevent fraud and misuse; and
- meet our legal and tax obligations.
We only collect and use personal information for purposes connected with our business.
5. Who we share it with
We don't sell your personal information. We share it only as needed to run our business, including with:
- Shopify — our e-commerce platform, which hosts the Website and stores order and customer data on our behalf;
- Payment providers — such as Shopify Payments, PayPal and card processors, to take payment securely;
- Couriers and freight providers — to deliver your order (we share your name, address and contact details);
- Email and marketing tools — to send communications you've opted in to;
- Analytics and Website service providers — to help us understand and improve the Website;
- Professional advisers (such as accountants) and regulators or authorities — where required or permitted by law; and
- A buyer or successor — if our business is sold or restructured.
We require our service providers to protect your information and use it only for the purposes we've engaged them for.
6. Storage overseas
Some of our service providers — including Shopify and certain payment, email and analytics tools — store or process personal information outside New Zealand (for example, in the United States, Canada, the European Union or Australia). Where we disclose personal information overseas, we take reasonable steps, consistent with IPP 12 of the Privacy Act 2020, to ensure it has comparable privacy protection. By using the Website and providing your information, you acknowledge it may be stored and processed overseas.
7. Cookies and analytics
Our Website uses cookies and similar technologies — small files stored on your device — to make the site work, remember your cart and preferences, understand how the site is used, and (where you've consented) support marketing. We may use tools such as Shopify's built-in analytics[, Google Analytics, and the Meta (Facebook/Instagram) pixel]. You can control or disable cookies through your browser settings, though some features may not work properly if you do.
8. Marketing and your choices
If you opt in, we may send you emails or messages about products, offers, events and BBQ content. You can unsubscribe at any time using the link in any marketing message, or by emailing us — consistent with the Unsolicited Electronic Messages Act 2007. We'll still send you essential service messages (such as order and delivery updates) even if you opt out of marketing.
9. How we protect your information
We take reasonable steps to keep your personal information safe from loss, misuse, and unauthorised access, use or disclosure — including secure hosting through Shopify, encrypted payment processing, and limiting access to those who need it. No system can be completely secure, but we work to protect your information and respond appropriately if something goes wrong.
10. How long we keep it
We keep personal information only for as long as we need it for the purposes described in this policy, or as required by law (for example, tax and business records are generally kept for seven years). When we no longer need it, we'll securely delete or de-identify it.
11. Your rights — access and correction
Under the Privacy Act 2020, you have the right to:
- ask whether we hold personal information about you, and to access it; and
- request that we correct information you believe is wrong.
To make a request, email info@bbqboi.nz. We may need to verify your identity. We'll respond as soon as reasonably practicable and within the timeframes the Privacy Act requires. There's normally no charge, and if we can't make a correction you've asked for, you can ask us to attach a note recording your request.
12. Privacy breaches
If a privacy breach occurs that has caused, or is likely to cause, serious harm, we'll notify the Office of the Privacy Commissioner and any affected individuals, as required by the Privacy Act 2020.
13. Children
Our Website and products are intended for adults. We don't knowingly collect personal information from children. If you believe a child has given us their information, please contact us and we'll take appropriate steps.
14. Third-party links
The Website may link to other sites (such as manufacturers, social media or payment providers). We're not responsible for the privacy practices of those sites — please review their privacy policies.
15. Changes to this policy
We may update this Privacy Policy from time to time. The current version will always be on this page, with the "last updated" date above. Material changes take effect when posted.
