Terms of service

These Terms of Service ("Terms") apply to your use of our website bbqboi.nz (the "Website") and to every order you place with us. By browsing the Website, creating an account, or placing an order, you agree to these Terms. Please read them carefully. If you don't agree, please don't use the Website or order from us.

These Terms work together with our Returns & Refunds Policy and Privacy Policy, which form part of these Terms.

Nothing in these Terms limits or excludes your rights as a consumer under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply.

We are a New Zealand–based retailer of barbecues, smokers, fuel, rubs, sauces, knives, accessories and related products, and an authorised Big Green Egg representative.


2. Eligibility and your account

  • You must be at least 18 years old, or have the permission and supervision of a parent or guardian, to place an order.
  • Some products — including knives, blades and other age-restricted items — may only be sold to customers aged 18 or over. By ordering these items you confirm you are 18+ and that you'll comply with all laws relating to their purchase, possession and use. We may refuse, verify, or cancel any such order at our discretion.
  • If you create an account, you're responsible for keeping your login details secure and for all activity under your account. Tell us promptly if you suspect unauthorised use.

3. Orders and acceptance

  • Placing an order is an offer to buy. A binding contract is formed only when we accept your order and dispatch the goods (or send confirmation of dispatch) — not when you receive an automated order acknowledgement.
  • We may, at our discretion, decline or cancel an order (for example, where goods are out of stock, where there's a pricing or description error, where we can't verify your details, or where we suspect fraud or on-selling). If we cancel an order you've paid for, we'll refund you in full.
  • We may limit quantities or refuse supply.

4. Prices, GST and payment

  • All prices are in New Zealand dollars (NZD) and, unless stated otherwise, include GST at the current rate (15%). A GST receipt is available on request.
  • Prices exclude delivery charges unless stated; delivery is calculated and shown at checkout.
  • We try to keep pricing accurate, but errors can occur. If we discover a genuine pricing error after you order, we'll contact you to confirm whether you wish to proceed at the correct price or cancel for a full refund. We're not obliged to supply at an incorrect price.
  • We may change prices at any time, but changes won't affect orders we've already accepted.
  • Payment is taken at the time you order, through our payment providers (which may include Shopify Payments, credit/debit card, PayPal, Apple Pay, Google Pay, Shop Pay and Union Pay). By paying, you confirm you're authorised to use the payment method.

5. Shipping, delivery and risk

  • We ship across New Zealand. Delivery options, costs and estimated timeframes are shown at checkout and may vary for rural, heavy or bulky items (such as smokers, kamados and pizza ovens).
  • Delivery timeframes are estimates only and not guaranteed. We're not liable for courier delays outside our reasonable control, though we'll help you follow up any issue.
  • Risk in the goods passes to you on delivery (or on collection, for click & collect). Ownership (title) in the goods remains with us until you've paid for them in full.
  • Please provide accurate delivery details. Re-delivery or redirection caused by incorrect details may incur additional cost.
  • For click & collect / pick-up in store, please bring your order confirmation and ID. Collect within a reasonable time of being notified your order is ready.

6. Returns, refunds and the Consumer Guarantees Act

  • If goods are faulty, not as described, or not fit for purpose, you have rights under the Consumer Guarantees Act 1993, and we'll provide a remedy as required by law. We do not contract out of the CGA for consumer purchases.
  • Our full process — including faulty goods, transit damage, wrong items, and our goodwill change-of-mind policy and its exclusions (such as opened consumables, fuel, used knives, gift cards and special orders) — is set out in our Returns & Refunds Policy.
  • Business customers: where you buy from us in trade (for business or resale, not personal use), the guarantees in the Consumer Guarantees Act do not apply, to the extent permitted by law.

7. Product information, images and availability

  • We take care to describe and picture products accurately, but images, colours and packaging are illustrative and may differ from the actual item. Manufacturer specifications can change without notice.
  • Listing a product doesn't guarantee it's in stock. If an item becomes unavailable after you order, we'll offer an alternative, a back-order, or a refund.

8. Barbecues, smokers and assembly

  • Some products require assembly and should be set up and used strictly in line with the manufacturer's instructions. Improper assembly, use, fuelling or maintenance may be unsafe and may affect your rights if it causes a problem (see our Returns & Refunds Policy).
  • Ceramic cookers (such as the Big Green Egg) should be inspected for transit damage before assembly or use.
  • Many products carry a manufacturer's warranty in addition to your CGA rights. These warranties are extra protection and don't reduce your statutory rights. We're happy to help with a warranty claim.

9. Gift cards

Gift cards are redeemable on the Website towards eligible purchases, are not redeemable for cash, and are subject to any expiry and conditions shown at purchase. Treat gift cards like cash — we're not responsible for lost or stolen cards.


10. Intellectual property

All content on the Website — including the Barbecue B.O.I. name and logo, our house-brand product names (such as Fire B.O.I. and the Smash Blade), text, graphics, photographs and layout — is owned by us or our licensors and protected by law. You may use the Website for your own personal, non-commercial shopping. You may not copy, reproduce, republish, scrape, or use our content or brand for any other purpose without our written permission.


11. Acceptable use of the Website

You agree not to:

  • use the Website unlawfully, fraudulently, or in any way that could damage, disable or impair it;
  • attempt to gain unauthorised access to our systems, accounts or data;
  • use automated tools to scrape, harvest or copy content or prices; or
  • introduce viruses or other harmful code.

We may suspend or restrict access to the Website, or cancel orders, where we reasonably believe these Terms have been breached.


12. Privacy and marketing

  • We handle your personal information in line with our Privacy Policy and the Privacy Act 2020.
  • If you opt in to marketing, we may send you emails or messages about products, offers and BBQ content. You can unsubscribe at any time using the link in any message, consistent with the Unsolicited Electronic Messages Act 2007.

13. Our liability

  • Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where you deal with us as a consumer. Those rights sit above these Terms.
  • The Website and its content are provided "as is". We don't guarantee the Website will always be available, uninterrupted or error-free.
  • To the maximum extent permitted by law, and except for our obligations under the consumer legislation above, we are not liable for indirect, special or consequential loss, or for loss of profit, data or opportunity, arising from your use of the Website or the goods.
  • To the extent we may lawfully limit our liability (including for business customers, where the CGA is excluded), our total liability for any claim is limited to the price you paid for the goods giving rise to the claim.

14. Events beyond our control (force majeure)

We're not responsible for delays or failures caused by events outside our reasonable control — including supplier or courier failures, natural events, power or network outages, strikes, or government action. We'll take reasonable steps to minimise any disruption.


15. Third-party links

The Website may link to third-party sites (for example, manufacturers or payment providers). We don't control those sites and aren't responsible for their content, products or privacy practices.


16. Changes to these Terms

We may update these Terms from time to time. The version on the Website at the time you place an order applies to that order. We recommend you review these Terms before each purchase. Material changes take effect when posted.


17. Governing law and disputes

  • These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
  • If you have a problem, please contact us first — we'll always try to resolve it fairly and quickly. If we can't, you may take the matter to the Disputes Tribunal, or report conduct you believe breaches the Fair Trading Act to the Commerce Commission. You can also seek guidance from the Citizens Advice Bureau or Consumer Protection.

18. General

  • If any part of these Terms is found to be unenforceable, the rest continues to apply.
  • Our failure to enforce a term isn't a waiver of it.
  • These Terms, together with our Returns & Refunds Policy and Privacy Policy, are the entire agreement between us regarding your use of the Website and your orders.
